Wills & Estates
Planning for the future does not have to be complicated.
A Will is a legal document that sets out how your assets are to be dealt with after your death, and who you can trust to carry out your wishes. Without one, NSW law decides – not you.
Our role is to make sure your intentions are clear and that the construction of your Will is properly documented.
Wills are also important in the context of a divorce. If you divorce or remarry, your Will can be impacted. For example, if you divorce, any provision for your former spouse becomes void and if you remarry, your Will is also void unless that Will expressly is drafted in contemplation of the marriage.
Our background in family law, means we are attuned to blended families, second relationships, children from prior marriages and complex personal dynamics, we draft Wills with these realities in mind.
Do not fall for the trap of drafting your own Will or purchasing ready-made Wills without understanding the legal effect of the clauses provided by them. We ensure the process is inexpensive and easy to understand.
As part of that process, clients often enter into Enduring Power of Attorney and Enduring Guardianship documents. A Power of Attorney allows you to appoint a representative that you trust to make financial and legal decisions on your behalf. This document can be particularly helpful if you want to appoint a trusted person to pay your bills, manage your bank accounts, deal with property or sign documents on your behalf.
Enduring Guardianship allows you to appoint a person you trust to make personal, lifestyle and medical decisions on your behalf. These decisions only take effect if you lose capacity to make those decisions. Without an Enduring Guardianship or an Enduring Power of Attorney, if you were to lose capacity, family members may disagree about your care and financial decisions may become delayed. These documents often reduce additional stressors for family members.
At Naddaf Legal we prepare these documents as part of a suite of estate planning documentation.
In addition, we assist executors and families after someone has passed away, including applying for probate, administering estates, advising on executor duties, and resolving estate-related issues.
