Surrogacy
Surrogacy
Surrogacy is a deeply personal and carefully regulated process. It is important to have clear legal advice from the outset.
In NSW before a child is conceived by way of a surrogate, both the surrogate and intended parent must comply with several legal requisites including entering into an Altruistic Surrogacy Agreement. As part of the surrogacy process, each party is required to obtain independent legal advice in relation to the arrangement.
Once the Agreement is entered into and after the birth of the child, legal paperwork must be prepared for lodging with the Supreme Court of New South Wales to apply to transfer the parentage of the child to the intended parent. This process allows the intended parent to thereafter become legally recognised as the parent of that child.
Naddaf Legal assists intended parents and surrogates through the stages of the surrogacy journey, including advising on eligibility requirements, preparing and reviewing surrogacy agreements, and guiding clients through the legal steps required after the child is born, including preparing and lodging your application for parentage orders.
In addition, we provide guided assistance for intended parents and donors who intend to start a family. Sperm donor arrangements and Egg donor arrangements impact future parenting involvement. That is why it is important that you document your agreement by way of a Donor Agreement and obtain appropriate advice as to how the law operates and the legal steps required to document your intentions.
Without an agreement in place, disputes often arise about the involvement of a donor in the life of the child. In Australia there are also counselling and legal requirements as part of all family planning arrangements.
If you require any assistance in family planning and fertility law, whether you are a surrogate, intended parent, sperm donor, or egg donor Naddaf Legal can assist you.
